Terms and Conditions

 

1. Orders and Shipping

We will endeavour to ship your order within 48 hours from receipt of payment (excluding weekends and public holidays).

The order will not be shipped until payment has been received in full.

Sales and shipments by Kelly Kettle Australia are available to all areas of Australia and New Zealand. All prices are in Australian dollars and are GST inclusive.

Freight charges are calculated automatically during the checkout process based on the total weight of the goods you have purchased and your location. The total freight costs are listed for you during the checkout process before the order is finalised and processed.

We aim to have all products listed on our website in stock but sometimes unforeseen supply problems or unexpected demand may occasionally result in stock being unavailable. Should there be a delay in dispatching your order we will contact you immediately to advise you within 2 business days of the reason for the delay. You may cancel such an order at any time prior to shipment for a full refund.

Postage is via Australia Post - standard delivery, express post or registered post. Allow approximately 2 to 7 working days for delivery.

Goods delivered via registered post will require a signature on delivery. If no one is present to sign for the delivery you will be required to collect the goods from the post office.

Insurance is included in the postage charge.

A full tax invoice will be enclosed with the order.

 

2. Returns and Refunds

All products are new and are covered by the Manufacturer's one year warranty. Faulty products may be returned for a full refund or replacement within 30 days of purchase. Faulty goods returned after 30 days and before one year will be replaced. If we are unable to replace the faulty product we will offer a full refund. Please contact us for return authorisation. Goods cannot be returned for change of mind.

4. Liability

Any liability of Kelly Kettle Australia in connection with goods supplied to you will, subject to any non-excludable liability for breach of conditions or warranties implied by legislation and to the maximum extent permitted by law, at the election of Kelly Kettle Australia be limited to the replacement of the goods or the supply of equivalent goods.

 

5. Changes To Terms

Each order is governed by the terms and conditions current when the order is placed. Kelly Kettle Australia may add to, delete or otherwise change these terms and conditions without notice. It is your responsibility to read and understand these terms and conditions each time you place an order.

 

6. Applicable Law

All purchases, and these terms and conditions, are subject to the laws of New South Wales, Australia.

Exclusion and limitation of liability
TO THE FULL EXTENT PERMITTED BY LAW WE HEREBY EXCLUDE ALL CONDITIONS AND WARRANTIES NOT EXPRESSLY SET OUT HEREIN. EXCEPT AS SPECIFICALLY SET FORTH IN ELSEWHERE IN THIS AGREEMENT, WE MAKE OR GIVE NO EXPRESS OR IMPLIED WARRANTIES INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR ARISING FROM A COURSE OF DEALING, USAGE OR TRADE PRACTICE, WITH RESPECT TO ANY GOODS OR SERVICES PROVIDED UNDER OR INCIDENTAL TO THIS AGREEMENT. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY US, OUR RESELLERS, AGENTS, REPRESENTATIVES OR EMPLOYEES SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THE EXPRESS WARRANTIES HEREBY GIVEN, AND YOU MAY NOT RELY ON ANY SUCH INFORMATION OR ADVICE.

1. Our total aggregate liability to you for any claim in contract, tort, negligence or otherwise arising out of or in connection with the provision of the Services shall be limited to the charges paid by you in respect of the Services which are the subject of any such claim and provided that you notify us of any such claim within one year of it arising.

2. In no event shall we be liable to you for any loss of business, contracts, profits or anticipated savings or for any other indirect or consequential or economic loss whatsoever.

Important note:In the event that this agreement constitutes a supply of goods or services to a consumer as defined in the Trade Practices Act 1974 or any other national, State or Territory legislation (the Acts) nothing contained in this agreement excludes, restricts or modifies any condition, warranty or other obligation in relation to this agreement and the goods and you where to do so is unlawful. To the full extent permitted by law, where the benefit of any such condition, warranty or other obligation is conferred upon you pursuant to any of the Acts, our sole liability for breach of any such condition, warranty or other obligation, including any consequential loss which you may sustain or incur, shall be limited (except as otherwise specifically set forth herein) to the replacement of the goods or the supply of equivalent goods or payment of the cost of replacing the goods or acquiring equivalent goods.

 

7. Warranty Information

We’re sure you will be delighted with your Kelly Kettle products. If you are experiencing a problem with your Kelly Kettle purchase, please take a minute to read the information below to determine if your issue is covered under the Kelly Kettle warranty.

Kelly Kettle Australia is committed to customer satisfaction, and we want to take the risk out of ordering with us. We want you to feel confident in your purchase and aim to make all aspects of ordering as hassle free as possible, especially with returns.

If you receive an item that is not what you ordered, is damaged in transit or you believe is faulty, please give us a call on (02) 9979 5735 or email us at support[at]kellykettle.com.au with photos of the fault/ damage if possible and a description as to what has happened.

WARRANTY REPAIR & REPLACEMENT SERVICE INSTRUCTIONS:
All Kelly Kettle Australia products are warranted to be free of manufacturing defects for a period of one year from the date of purchase. Kelly Kettle Australia's sole obligation in the event of such defects becoming apparent during this period is to replace the defective product with a replacement product.

The Kelly Kettle Australia products are designed to be used in the rugged outdoor environment, however, the warranty does not extend to damage to the product caused by accident, abuse, mishandling, dropping, crushing or normal wear and tear. Kelly Kettle Australia assumes no liability for any accident, injury, death, loss, or other claim related to or resulting from the use of this product. In no event shall Kelly Kettle Australia be liable for incidental or consequential damages relating to or resulting from the use of this product or any of its parts.

1. Before sending anything back to Kelly Kettle please contact our Customer Support via email (support[at]kellykettle.com.au) or by phone. If our Customer Support Team determines that your problem qualifies under warranty coverage, you will be issued an RMA (Return Merchandise Authorisation) number.

2. Carefully box up the product for return.

3. Please include a copy of your original sales receipt and a clearly written explanation of the problem.

4. Include with the package the exact address for sending the replacement product back to you.

5. Write your RMA number on the outside of the box and send to:

6. Once we have inspected the returned product and agreed that it has a manufacturing defect we will ship a new replacement product to you. We will reimburse your return postage costs.
7. Normally products are kept in stock but if for any reason we cannot supply a replacement within 30 days we will offer you a full refund.

8. Products may be improved from time to time and a direct replacement may not be available. In which case we will offer the nearest direct equivalent product.

Returns that don’t qualify for warranty coverage will be returned to customers. We will contact you before returning the product to discuss options.
